Bávaro International Airport (AIB) Defense Council Clarifies Legal Status Amidst Appeals
In response to a statement released by the defense team of the Eastern Airport Corporation (CAE) and the Puntacana Group (GPC) on Monday, the Defense Council of Bávaro International Airport (AIB) issued a press release clarifying the current legal situation of the company.
The AIB’s legal defense emphasized that the sentences mentioned in the statement have all been subject to appeals aimed at rectifying constitutional violations committed against the fundamental rights of AIB. Therefore, they dismissed the veracity of claims suggesting that justice has definitively halted the construction of the air terminal.
The Defense Council asserted that no authority has rendered a final judgment in the ongoing judicial processes related to AIB. They expressed concern that misinformation may arise from statements regarding non-finalized sentences, reiterating that the country’s justice system comprises three jurisdictional instances and a constitutional one, allowing for appeals to higher courts.
The case of Bávaro International Airport has been the subject of four sentences issued by the Second Chamber of the Superior Administrative Court, all under the same composition of judges. Two of these sentences (January 28 and December 16, 2022) were handed down without holding hearings to hear the involved parties, thereby violating the fundamental right established in Article 69-4 of the Constitution.
Dr. Emmanuel Esquea Guerrero, a member of the Defense Council of Bávaro International Airport, expressed their firm commitment to defend the legality and transparency of the project. They emphasized that all aforementioned sentences are under appeal in an effort to rectify the constitutional violations of fundamental rights.
Furthermore, the Defense Council expressed concern over attempts to influence judges through public opinion in relation to pending appeals. They found it unacceptable that a resolution from a body dependent on the Executive Branch could disregard the rights acquired by AIB, which are supported by a contract signed by the Dominican State with the authorization of the President of the Republic.
The Defense Council concluded by reiterating their trust in the justice and legality of their actions, asserting their dedication to continue fighting to rectify any violations of fundamental and constitutional rights.
