Court Halts Bavaro Land Dispute Eviction Temporarily
A court in La Altagracia has temporarily suspended the enforcement of Resolution No. 360 in the Bavaro land dispute, which ordered the eviction of the Cooperativa Familiar de Viviendas y Servicios Múltiples del Este (COOPFVIESTE) from a 14,016.15-square-meter parcel of public land. The decision was issued by the Second Chamber of the Original Jurisdiction Land Court on September 10, 2026.

The land, registered under No. 1000028340, has been classified as public domain property since October 14, 2010, according to judicial records. The suspension came after COOPFVIESTE filed a legal motion on August 13 to halt the resolution issued by the State Attorney for Real Estate Jurisdiction, Eastern Region, on August 3.
Judge Yuri Isabel Espino Geneux determined that enforcing the eviction while a reconsideration request remains unresolved could cause irreversible harm. The court emphasized that the suspension is provisional and does not alter the land’s status as public property or recognize COOPFVIESTE as its owner.
Uridy Marte, legal representative of the cooperative, confirmed that the filing has temporarily paused the eviction process, but clarified that the decision does not prevent future enforcement. The reconsideration request remains pending before the court.
The ruling allows for immediate enforcement under Dominican real estate law but also permits an appeal. The suspension applies only to the execution of Resolution No. 360, not to the legal classification of the land. Local governance issues have increasingly drawn public attention in recent months.
